Usage Agreement

Introduction to the User Agreement:

Welcome to our online store (registered under number "4030393951"), and we hereby inform you that below you will find the terms and conditions governing your use of this store and all legal consequences arising from your use of the store's services over the internet via this electronic platform. Any use by any person of (Masaat Al Hayat Store), whether a consumer of the store's service or product or otherwise, constitutes their approval and acceptance, with full legal capacity, of all the provisions and terms of this agreement, and is an affirmation of your commitment to its regulations and what is stated therein. This agreement applies to all types of dealings between the user and the store, except for dealings related to personal status and dealings related to the issuance of deeds related to real estate transactions. This agreement is considered valid and effective once you approve it and begin registering (with Masaat Al Hayat Store) in accordance with Article 10 of the Saudi Electronic Transactions Law.

Article One - Introduction and Definitions:

The above introduction is an integral part of this Agreement. Below you will find the meanings and definitions of the main terms used in this Agreement:

1. (Diamond of Life Store) This term means (Diamond of Life Store), and this definition includes all forms of (Diamond of Life Establishment) on the Internet, whether it is an electronic application, a website on the Internet, or a commercial store.

2. (User) This term refers to every consumer who purchases the product or service from the store through its electronic platform.

3. (Agreement) This term means the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.

Article Two - User Legal Capacity:

1. The user acknowledges that he has the legal capacity recognized by Sharia and the system to deal with the store, or that he is at least eighteen years old.

2. The user agrees that if he violates this article, he will bear the consequences of this violation before third parties.

Article Three - Nature of the commitment ( Masa Al Hayat Trading Establishment ):

1. The commitment of (Masaat Al Hayat Store) towards consumers or users is to provide (the service or product).

2. (Masaat Al Hayat Store) may provide other services such as after-sales services or other related services, depending on the nature and type of (service or product) required by the user.

Article Four - Controls for using ( Masaat Al Hayat Store ):

1. The user is committed to using the electronic platform of (Masaat Al Hayat Store) in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.

2. When purchasing a service or product (Masaat Al Hayat Store), the user undertakes not to use this service or product in a manner that violates public morals and the regulations in force in the Kingdom of Saudi Arabia.

Article Five - Accounts and Registration Obligations:

Upon applying to join the membership of (Masa Al Hayat Foundation) as a user, you are obligated to disclose specific information and choose a username and a secret password to be used when accessing the services of (Masa Al Hayat Store). Thus, you have agreed to:

1. You are responsible for maintaining the confidentiality of your account information and password, and you agree to notify (Masaat Al Hayat Foundation LLC) of any such information.

) Immediately report any unauthorized use of your account information at (Masaat Al Hayat Store) or any other breach of your confidential information.

2. (Diamond of Life Store) will not be responsible in any way for any loss that may be incurred by you directly or indirectly, morally or materially, as a result of revealing your username or password information.

3. You are committed to using your account or membership with (Masaat Al Hayat Store) yourself, as you are fully responsible for it, and if someone else uses it, this is evidence that you have authorized him to use the store in your name and on your behalf.

4. When using (Masa Al Hayat Trading Est.), you agree to use it with all seriousness and honesty.

5. You undertake to disclose true, correct, current, complete and legal information about yourself as required during registration with (Masa Al Hayat Trading Est.) and you undertake to update your data if it changes in reality or if necessary.

6. (Masaat Al Hayat Store) is committed to treating your personal information and contact addresses with complete confidentiality.

7. If it becomes clear to (Masa Al Hayat Trading Est.) that you have disclosed information that is false, incorrect, outdated, incomplete, illegal, or in violation of the User Agreement, (Masa Al Hayat Store) has the right to suspend, freeze, or cancel your membership, store, or account on the platform, without prejudice to (Masa Al Hayat Store)’s other rights and legitimate means of recovering its rights and protecting the rest of the users.

8. In the event of non-compliance with any of the above, the management of (Masa Al Hayat Trading Establishment) has the right to suspend or cancel your store or membership or block you from accessing the services of (Masa Al Hayat Trading Establishment) again.

Article Six - Electronic Communications and Official Means of Communication:

1. The parties to this agreement agree that communication will be via the email registered on the platform.

2. The User agrees that all agreements, notices, statements and other communications provided electronically shall be deemed equivalent to their written counterparts and shall be conclusive evidence in meeting regulatory and legal requirements.

3. The user agrees to the possibility of communicating with him and informing him of any provisions related to this agreement or related to dealing with him by the management of (Masaat Al Hayat Store) broadcasting general messages to all users or to specific users of (Masaat Al Hayat Trading Establishment).

Article Seven - Amendments to the User Agreement and Fees: (Diamond of Life Store) may notify you of any amendment to this agreement in accordance with the official means of communication under this agreement, and accordingly your obligations will be doubled or your rights will be diminished in accordance with any amendments that may be made to this agreement.
In the event of an objection to any amendment to the User Agreement, (Diamond of Life Store) hopes that you will stop using its services, as your mere access to your account or use of the store constitutes your acceptance of the amendments and full and complete consent, negating any ignorance.
All fees are calculated in Saudi Riyals, and the user must pay all fees due on the platform, in addition to any other expenses added by (Masaat Al Hayat Store), provided that payment is made through the approved, specified and available means through the store.
Diamond Life Store may charge some users fees depending on the offers, products or services they request or the fees or taxes imposed by the state on the nature of the product or service.
(Diamond of Life Store) reserves the right to add, increase, decrease or deduct any fees or expenses under the articles, terms and conditions of the User Agreement, for any user, regardless of the reason for their registration.

Article Eight - Payment and settlement services for stores in ( Masaat Al Hayat Trading Establishment ):

1. (Masa Al Hayat Trading Est.) provides, through its partners, the payment and settlement system in (Masa Al Hayat Trading Est.) which can be done entirely online through the payment options available in (Masa Al Hayat Store) or through any payment method provided by (Masa Al Hayat Store) from time to time.

2. (Masaat Al Hayat Store) is committed to setting the price of the service or product that it displays in its store according to the recognized market value.

3. (Masa Al Hayat Store) is committed to providing invoices, receipts, and receipts for all amounts and profits generated in its store, and is committed to giving the user an invoice for his purchase of a service or product (Masa Al Hayat Trading Establishment).

4. (Masa Al Hayat Trading Est.) is committed to providing the generally accepted accounting specifications in its online store, in application of the provisions of this agreement, and in view of the legal, economic, commercial and regulatory interests in this organization.

Article Nine - Your Personal Information and Transaction Details Information:

1. The user acknowledges that he grants (Masa Al Hayat Trading Est.) an unlimited, global, permanent, irrevocable, royalty-free right and license to use any personal or other information or materials that he has provided or supplied to the (Masa Al Hayat Store) platform or announced on the platform by joining or using it, through the designated forms for communication and registration, or via any electronic message or any of the communication channels available on the platform. This is for the purpose of achieving any of the interests that the platform deems appropriate.

2. The provisions of confidentiality of consumer information are subject to the rules of the “Privacy and Confidentiality Policy” of (Basma Sorour Medical Foundation), and to the provisions contained in this agreement related to confidentiality of information.

Article 10 - Intellectual Property:

1. The intellectual property rights of (Masa Al Hayat Trading Est.) are rights owned by (Masa Al Hayat Trading Est.) in full, whether they were owned by them before or after the establishment of this electronic platform.

2. The user or consumer respects the intellectual property rights of (Masa Al Hayat Store), which includes (Masa Al Hayat Trading Establishment) itself, and the words, logos and other symbols of (Masa Al Hayat Trading Establishment) or displayed on (Masa Al Hayat Trading Establishment), as (Masa Al Hayat Trading Establishment), and every right that follows (Masa Al Hayat Trading Establishment), are rights fully owned by the intellectual property of (Masa Al Hayat Trading Establishment).

Article Eleven - Responsibility of ( Diamond of Life Store ):

1. (Masa Al Hayat Trading Est.) is committed to conducting its business through this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia, and in accordance with the provisions of this agreement.

2. (Masa Al Hayat Trading Est.) shall not be liable for any claims arising from errors or negligence, whether caused directly, indirectly, incidentally, by the user or by a third party such as shipping companies.

3. (Masa Al Hayat Trading Est.), its employees, owners and representatives are committed to ensuring that the (product or service) is sound, legitimate and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is used for legitimate purposes.

Article Twelve - Confidentiality of Information:

1. (Masa Al Hayat Trading Est.) adopts (physical, organizational and technical) standards to protect users and prevent unauthorized access to and storage of users’ personal information.

2. You, as a user, acknowledge that the Internet is not a completely secure medium, and the confidentiality of your personal information cannot be 100% guaranteed through (Masa Al Hayat Trading Est.).

3. (Masa Al Hayat Trading Est.) has no control over the actions of any third party, or others, such as other web pages linked through links to the platform or third parties claiming to represent you and others.

4. You acknowledge and agree that (Masa Al Hayat Trading Est.) may use the information you have provided to it, for the purpose of providing services to you at (Masa Al Hayat Trading Est.), and to send you marketing messages, and that the privacy at (Masa Al Hayat Store) regulates the collection, processing, use and transfer of your personal identity information, and the rules of information confidentiality are subject to the “Privacy and Information Confidentiality Policy” of (Masa Al Hayat Trading Est.).

Article Thirteen - Restriction of Access or Membership:

(Masa Al Hayat Trading Est.) may suspend or cancel a user’s membership or restrict a user’s access to the Platform Services at any time, without notice, for any reason, and without limitation.

Article Fourteen - Replacement Policy:

1. Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to replace the product provided to him by (Masa Al Hayat Trading Est.) within seven days following the date of receipt of the product, and he does not have the right to replace the product after the seven days have passed.

2. To replace the product, it must be in good condition and the consumer must not have used the product or benefited from it. (Masa Al Hayat Trading Est.) has the right to inspect the product before replacing it to ensure its safety.

3. The consumer is not entitled to replace the product in the following cases:

If the product was manufactured based on the consumer’s request or according to specifications specified by him, with the exception of products that are defective or that do not meet the specifications specified by the consumer.

· If the product is a video tape, disc, CD or software that has been used.

· If the product is newspapers, magazines, publications, books, or anything else that is considered to be literature.

If the product is defective due to the consumer’s mishandling.

· If the contract covers the provision of accommodation, transportation or catering services.

· If the contract deals with the purchase of software download products over the Internet.

Article Fifteen - Return Policy:

1. Without prejudice to the provisions of the contractual and statutory warranty, the consumer has the right to cancel the contract and return the product provided to him by (Masa Al Hayat Trading Est.) within three days following the date of receipt of the product, and he has no right to that product after the three days have passed.

2. To return the product, it must be in good condition and the consumer must not have used the product or benefited from it. (Masa Al Hayat Trading Est.) has the right to inspect the product before returning it to ensure its safety.

3. The consumer is not entitled to return the product in the following cases:

· If the product is a video tape, disc, CD or software that has been used.

· If the product is newspapers, magazines, publications, books, or anything else that is considered to be literature.

If the product is defective due to the consumer’s mishandling.

· If the contract covers the provision of accommodation, transportation or catering services.

· If the contract deals with the purchase of software download products over the Internet.

4. If the provisions of the aforementioned return policy are met, the consumer has the right to terminate the contract and return the product to (Basma Sorour Medical Establishment) with a refund of the amount paid.

Article Sixteen - Applicable law or regulation:

This User Agreement is governed by and formulated in accordance with the laws, regulations and legislation in force in the Kingdom of Saudi Arabia, and is fully and completely subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.

Article Seventeen - General Provisions:

In the event that any provision or clause contained in this User Agreement is cancelled or that any provision or clause contained in the User Agreement is no longer valid, such a matter does not cancel the validity of the remaining provisions, clauses and terms contained in the User Agreement and they remain valid until further notice from the management of (Masaat Al Hayat Store).

This User Agreement - which may be amended from time to time as appropriate - constitutes the User Agreement, working mechanism, understanding, agreement and contract between (Masaat Al Hayat Store) and the user. Both parties to this agreement also agree to take into consideration the following:

1. The Arabic language is the language used when interpreting the provisions of this Agreement, or when translating it into another language.

2. All prices displayed for services or products (Masaat Al Hayat Store) may be modified from time to time.

3. The promotional or marketing offers that may be made by (Masa Al Hayat Store) are temporary offers, as (Masa Al Hayat Store) has the right to modify or stop these promotional or marketing offers at any time.

4. The parties to this agreement are committed to dealing with each other in a manner that does not violate the Sharia rules and applicable laws and regulations related to the nature of the dealings between (Masaat Al Hayat Store) and the user.

5. This User Agreement shall not be cancelled except by a decision issued by the management of (Masa Al Hayat Trading Establishment).
